Joint Center Files Public Comment on Federal Trade Commission’s Proposed Enforcement Policy Statement Regarding Personalized Pricing
The Joint Center submitted public comment on the Federal Trade Commission’s proposed enforcement policy statement regarding personalized pricing.
From the comments: “…[T]he Joint Center supports the Commission’s effort to address unfair and deceptive personalized pricing practices under Section 5 of the FTC Act. We particularly support the Commission’s recognition that consumers should receive clear and conspicuous information when prices are personalized using their personal data. At the same time, we encourage the Commission to look beyond disclosure alone and consider the broader implications of systems designed to estimate consumers’ willingness to pay, the difference between genuine consumer preference and constrained consumer choice, the potential for personalized pricing to compound existing economic disadvantages, and the practical challenges regulators may face in detecting and investigating increasingly sophisticated pricing systems.”
